An appeal to the circuit court, brought by the defendant-respondent State Highway Commission of Wisconsin, pursuant to the
provisions of sec. 32.05(10), Stats., 1 from an award of damages made by the condemnation commission of Milwaukee county.
The condemnation commission had increased the award originally made by the State Highway Commission to the Rammingers when
the property in question was acquired. The record before this court fails to disclose the original award made by the commission,
but does reveal that the condemnation commission increased the original award to $8,400. Trial was had to the circuit court for Milwaukee county and a jury, and a single special verdict question was submitted asking
the jury to determine the fair market value of the plaintiffs' property on May 15, 1959, the date the property was acquired
by the State Highway Commission. The jury's answer was $6,500. Judgment was entered on the verdict on November 26, 1962, decreeing
that the defendant State Highway Commission recover from the plaintiffs the difference between the condemnation commission's
award of $8,400 and the amount of the jury verdict, plus costs and disbursements. The plaintiffs appeal from the judgment.
