Two actions in the Ramsey County District Court, consolidated for trial, arising out of a collision between an automobile
driven by Rt. Rev. Edmund B. Leary and owned by his passenger, Florine M. Smith, and a truck driven by Raymond F. Hentschel
and owned by his employer, the city of St. Paul. Hentschel brought an action against Mrs. Smith to recover for personal injuries
allegedly sustained in the collision, and Mrs. Smith brought an action against him and the city to recover for personal injuries.
In the latter action the city filed a counterclaim against Mrs. Smith and a third-party complaint against Leary for damages
to its truck, workmen's compensation benefits paid to injured employees, and, as to Leary, for any amount it might be liable
to pay Mrs. Smith. The action brought by Mrs. Smith was settled in accord with a stipulation that the city pay her $11,156.95
and further providing that the city would dismiss its claim against Leary for any amount it paid Mrs. Smith. Judgment was
entered pursuant thereto. Thereafter the court, Harold J. Schultz, Judge, granted Leary's motion for summary judgment in the
third-party action and denied Mrs. Smith's like motion in the action brought by Hentschel. The city of St. Paul appealed from
