On July 22, 1953 the appellant, Raymond F. Johnson, an employee of the defendant, Walco Engineering and Construction Company, suffered accidental injury arising out of his employment. When a scaffolding on which the appellant was working collapsed he fell 20 feet to the ground. In the fall he was caught underneath the armpits by a horizontal crosspiece. The application for Workmens Compensation benefits was filed on March 27, 1954. A hearing was started on May 18, 1954, and was adjourned from time to time. Because of the nature of the injuries, the Industrial Commission appointed an impartial physician to make an examination of the extent of the appellants disability. On September 18, 1956 a hearing was held before an Industrial Commission examiner. At that time compensation had been paid the appellant by the employer through the defendant Standard Accident Insurance Company, its insurer, in the amount of $5,614 in addition to the medical bills.
