Action by Raymond L. Millay against Edwin Russell and his insurer to recover damages for personal injuries sustained in an automobile collision. The collision occurred at night. Millay was in a driveway, about to enter Highway 151, but had stopped his car. It was struck by Russells car, which had been traveling on the highway. It appears that before reaching the point of impact, Russell had been rounding a curve toward his right, saw Millays headlights when they could have been 300-400 feet away, and thought Millay was coming around the curve. One may surmise that Russell thought until too late that in order to follow the highway he should pass to the right of Millays lights.
